Astrocard is a free to play distributed gaming application, running on the Ethereum blockchain. You are able to earn, purchase, transfer and trade digital collectible items ("Cards"), which can be interacted with via our services.

Acceptance

Astrocard, and any related service ("services", "service") is operated by CheatCode Media Group Ltd ("CheatCode", "we", "us") in conjunction with MetaClient LLC ("MetaClient"). It can be accessed at astrocard.io

By using this service, you confirm that you have reviewed these Terms and Conditions, including our Privacy Policy (available on our website). You also have parental consent to use this service if under the age of 18, and must not use this service is you are under the age of 13.

If you are a parent legal guardian permitting a child under the age of 18 to use this service, you are agreeing to

1. supervise the minor's use of the service;
2. assume all risks, liabilities and responsibilities resulting from the minor's use of the service;
3. ensure that the content on the services are suitable for the minor;
4. ensure all information submitted to us by the minor is accurate; and
5. provide the consents and responsibilities outlined on all service policies on the minor's behalf

Game Accounts

You are required to create a user account ("Account") to use this service. You must ensure any personal information provided to us when creating an Account is accurate and up-to-date.

In order to create and own any Cards not classified as "Basic" in the "Rarity" descriptor, you are required to provide an Ethereum wallet address after creating an account.

Using the service

By using the service, we grant you a non-exclusive, non-transferable, non-sub-licensable (unless otherwise permitted under these Terms), personal and revocable license to access and use services.

Transactions which take place on service are managed and confirmed via the Ethereum blockchain, which is publicly visible to any entity who should wish to view it.

You may be required to use a third party service (such as MetaMask or Coinbase) to use services. You accept that you may not be able to use certain features of service in the event that you do not use these third party services.

Referrals and Promotions

We may occasionally offer incentives to refer services to other persons ("Referral Scheme"). You agree that by participating in such a scheme, you will not act in a way which fraudulently or unfairly bestows the benefits of a Referral Scheme on yourself. This includes, but is not limited to, creating multiple accounts using your referral link. We reserve the right to withold any rewards or benefits from a Referral Scheme in the event of this behaviour. We also reserve the right to terminate your account should we detect this behaviour.

Prohibited Behaviours

You agree not to, or to authorise any person on your behalf to use this service in contrary to rules or policies which can be found on this site, or in a way which we determine - at our discretion - to be cheating, abusing, or otherwise using third party software with our service.

Each person may only create one account, and we reserve the right to close any "alternative" accounts (a secondary account created by a person).

We also prohibit automated actions performed on our game or services to gain any benefit. For clarity, this is commonly referred to as "farming".

Purchases made directly with Astrocard

Should we offer direct payment for items or services (including Cards), the purchase is for the price clearly stated at the point of sale, inclusive of tax and any promotional discount.

These terms of service will be updated prior to the release of a sale of a collection of Cards ("Card Pack") to inform the statical probabilities of the contents of such a sale. While Astrocard will make every effort to meet these probabilities, the actual contents of a Card Pack may vary.

When your transaction has successfully been processed, we will provide you with tracking information, including an order transaction number. It is your responsibility to ensure the purchase details, including selected items and pricing, before you place a transaction.

You must pay us the full price of each item as described on the service. You must not pay, or attempt to pay, the advertised Price by fraudulent or unlawful/illegal means. You must pay the price via a prescribed payment method, available on the "Checkout" page of our site.

You are responsible for paying any tax or fee related to a payment, including the Etherum network transaction fee (commonly referred to as a "gas fee").

Communication

The service may facilitate multiple communication methods, including through a Discord server and in-game chat functionality. You acknowledge and agree that you are not permitted to send communication which contains profane, illegal, defamatory, business advertisement, spam, fear-mongering, insults, personal information or other illicit language.

We reserve the right to remove any communication in which we deem to be inappropriate. We also reserve the right to disable your ability to participate in such communication methods at our discretion.

Restrictions

You must not access or use the service except as permitted by these Terms. You, or any agent acting on your behalf, must also not:

• use the service which is in breach of any applicable law;
• violate any Intellectual Property of another entity;
• distribute via the service indecent, defamatory, abusive, offensive, menacing or unwanted material;
• use the service in a way which disrupts the experience of another user;
• introduce to our networks or systems a malicious software, including but not limited to viruses, worms or trojan horses;
• use any program/script, or work to interfere or disable another person's use of the service;
• use the service to carry out a security breach or disruption of a network;
• harass another user via our messaging platform; or
• sell or obtain Cards or other items for investment purposes

Intellectual Property

Between Astrocard and yourself,

1. All Data and Intellectual Property remains your property; and
2. you retain any and all rights, title and interest in, and to, the Data, including all copies, modifications, extensions and derivative works thereof.
3. You grant us a limited license to copy, transmit, store and save or otherwise access the Data solely to:
   • supply the services;
   • diagnose and address problems with the services;
   • enhance and modify the services;
   • develop other products (providing we de-identify the data); and
   • as reasonably required to under this policy

You must, at all times ensure the integrity and license to the Data. You warrant that:

1. you have all the necessary rights, releases and permissions to provide any Data to us;
2. to grant the rights to us in these Terms; and
3. the Data and its transfer to and use by us, as authorised by you under these Terms do not violate any Laws (including those relating to export control and electronic communications) or rights of any third party, including IP rights, rights of privacy, or rights of publicity;
4. you further guarantee that any use, collection and disclosure authorised in this policy is not inconsistent with the terms of any applicable privacy policies.

We assume no responsibility or liability for the Data, and you are solely responsible for the Data and the consequences of using, disclosing, storing or transmitting it.

Liability

Despite anything to the contrary, to the maximum extent permitted by law:

• our maximum aggregate Liability arising from or in connection with these Terms will be limited to, and must not exceed the portion of the Price paid by you to us for the Items subject to its relevant claim
• we will not be liable to you for any Loss or Damage, whether under contract, tort (including negligence), statute, indemnity or otherwise caused by your transactions on service.

when arising from:

• your use of the service;
• failure or delay in providing the service;
• your breach of these Terms;
• your failure to comply with any law or regulation; or
• the service environment where caused by or contributed to by any
  1. event outside our reasonable control;
  2. a fault, defect, error or omission in your device or data; or
  3. act or omission of you, your related parties, or any third party (including customers, suppliers, end users or employees), and
  4. in any event, any error, omission or lack of suitability (or the absence of or reduction in any anticipated result, outcome, or benefit) with respect to the service.

To the maximum extent permitted by law, we will not be liable for any loss or damage. You further indemnify and continue to hold us harmless from and against any and all claims, damages, liabilities, losses, liabilities, costs or expenses (including but not limited to reasonable legal and accounting fees) arising from or in connection with your use of the service.

Termination

You may terminate these Terms at any time by closing your account. We may terminate these Terms if we believe that you have breached these Terms or are in breach of any law or regulation. We may terminate these Terms if you have breached a term defined in this policy. We will usually provide you with a reasonable opportunity to correct your breach of these Terms. If we terminate these Terms, we will:

• suspend your access to the service for up to 60 days pending an appeal;
• notify you by email; and
• should there be no appeal within 60 days, remove your data from our systems inline with our Privacy Policy

General Terms

We reserve the right to change or remove features of the service, or to suspend or terminate the service. We may, at any time and at our discretion, modify or remove any content on the service. We may also change, suspend or terminate the service at any time. We will not be liable to you or any third party for any modification, suspension or termination of the service.

We also reserve the right to vary these Terms at any time. We will notify you of any changes to these Terms via an email. You should check these Terms from time to time to ensure that you are aware of any changes.
