CHEATCODE MEDIA GROUP ONLINE SERVICES PRIVACY POLICY

CheatCode Media Group Ltd. and its subsidiaries (collectively "CheatCode", "us", "we") cares and respects the privacy of its players, customers and online visitors; and recognises the importance of providing a private, safe and secure environment for them.

1. What personal information is collected, and how do we use it?

Information collected from you

If an online visitor submits information to CheatCode typically be through either:

  1. the purchase of goods or services,
  2. product or account registration,
  3. message boards or forums,
  4. email campaigns,
  5. customer service or product support,
  6. newsletters

We do not require this information to gain access to our websites. However, you may not be able to utilise certain products, features, or services without providing us with certain information (user registration).

Purchasing a product or service directly through CheatCode may require additional information, such as a valid debit/credit card number, expiration date, and shipping/billing address.

For some activities, we may ask you to create a user account, which includes a username and password, and may additionally require you to provide your age, date of birth, gender, and/or email address.

In specific cases, we may ask you to provide a copy of official identification to verify your identity and/or account ownership. Unless we have the need to establish, defend, or exercise our legal rights, when this information is provided to us, it will be deleted within 30 days of the date it was received, or as soon your identity has successfully been identified.

CheatCode also reserves the right to monitor and access any communication performed via our products and services, including, but not limited to conversation boards, chat, and other online services.

Information Collected Automatically

In addition, your web browser or game software may transmit certain geographic and technical information to us (e.g. system information, game data, analytics). We may use this information to generate aggregate statistics about our users.

We may also use such information for our security, system integrity and for enforcemnet purposes. We may also collect iP information, which we may use to infer your approximate location.

Information collected from third parties

CheatCode may also collect information from third parties, such as third-party advertising companies, such as Google Adsense, Google Analytics, and other third-party services. We may use this information to provide you with targeted advertisements and to improve our services.

CheatCode may enhance or merge the personal information collected by CheatCode with data from third parties in order to update your contact information, perform market analysis, or improve our products, services or systems.

How we use your personal information

The personal information you provide CheatCode, and that CheatCode collects automatically, will allow us to provide our services, fulfill your service orders, alert you of new products/services, handle/route your customer service or technical support questions or issues; and/or to notify you of opportunities, contents, promotions or other events/offers.

We also use this information to secure our services and users, prevent cheating and fraud, to monitor for behaviour which violates our Terms of Service, and to enforce our legal rights and agreements.

Additionally, communications made using any CheatCode product or service should not be considered private.

Should our systems detect abusive/toxic behaviour, or another player or customer report a chat message in a public chat, the chat transcription will be saved to our database and used for the purpose of moderation.

You acknowledge and agree that you have any expectation of privacy concerning the transmission of any user generated content or communications, including without limitation chat text and message board postings.

We may use your personal information for internal marketing or demographic purposes, and so we can adapt our products and services to better suit your needs. We do this to better understand and serve our players and customers.

Personal information submitted by individuals acting solely in a business capacity is not subject to the uses set forth above or to any other practices stated in this policy.

California Collection Notice

Below we identify each category of personal information that we have collected in the last 12 months. For each of the category of personal information we have collected, we also identify:

  1. the source(s) from which the information was collected;
  2. the purpose(s) for which it was collected; or
  3. the categories of third parties, if any, which it has been shared.

Any data within each category may be shared with third parties for the following purposes:

  • With partners and service providers to operate our systems, deliver goods or services you have requested;
  • With other players and/or the general public (through your use of certain features of our software);
  • For legal reasons or in the event of a dispute;
  • If necessary, to protect the vital interests of any person (e.g. an immediate threat to life); and
  • In connection with the sale of our businesses or assets

2. What type of communications may you receive?

Offers

We may occasionally send you information on products, services, special deals, and promotions. We will only send you offers that are relevant to your interests and that we believe will be of interest to you. Additionally, we will only send you offers if you consent to it. Consent can be revoked at any time by clicking on the "unsubscribe" link in the email, or by updating your account settings.

Service-related Announcement

We will send you strictly service related announcements when it is necessary to do so. This includes important notifications about your account security, such as password reminders, unknown logins and sensitive data changes. You are unable to opt out of these communications as they are not promotional in nature.

3. Who is collecting your information?

When you are asked for information while using a CheatCode service, you are providing the information to CheatCode Media Group Ltd. If you are using a service operated "Astrocard", a trading name of MetaClient LLC, MetaClient LLC will also be collecting your information.

Occasionally, CheatCode may use third party contractors to collect and process personal information on its behalf. In all instances, CheatCode controls the use of your data via written contracts, which conform to this Privacy Policy.

Some services are provided with partner companies. For instance, if you use a service that requires you to make a purchase, you may be asked to provide your credit card information to the partner company, or in the case of cryptocurrency, to the cryptocurrency exchange (e.g. Coinbase or OpenSea).

CheatCode cannot always control the use of your information by third parties. While we cannot guarantee that third parties will not unlawfully use your information, we will take reasonable steps to protect your privacy and ensure that your information is not unlawfully used.

Our websites may include certain social media features. These features may collect information about how you interact with them, and may collect data such as your internet protocol ("IP") address, which page you are visiting on our websites, and may set a cookie to enable the feature to function properly.

Social media features and widgets are hosted by a third party, or hosted directly on our websites. Should you use a third-party feature, your interactions with these features are governed by the privacy policy of the company providing it.

4. Who may your personal information be shared with?

CheatCode will share your personal information with third parties only in the ways detailed in this Privacy Policy. However, CheatCode may share non-personal information with third parties with third parties. We additionally share unique identifiers specific to your device with third parties to tailor content and adjust or improve our services.

We reserve the right to disclose your information if we are required to do so by law. We may also disclose your information to law enforcement or other government officials or in civil litigation situations, in connection with the enforcement of our rights or your legal obligations.

We may share your information with third party contractors to perform services on our behalf. In these situations, a written contract between CheatCode and the vendor shall control such disclosure, and the vendor must agree to reasonable levels of security regarding your data. The vendor will not be permitted to use your data except as required for its services to CheatCode. If your data is anonymised, the vendor is permitted to use your data for other purposes.

Your personal information is also an asset of CheatCode - as is the case with any business. In the event that CheatCode Media Group Ltd., or a specific line of business is sold, your personal information may be disclosed to a relevant third party to allow you to receive service and support in reference to that line of business.

In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of CheatCode's assets, your personal information may be transferred to the new owner.

CheatCode may have multiplayer communication functions, such as chat features, where users can exchange messages with one another. When posting to such a service, this information is being made publicly available and the user does so at their own risk. If your personal information is posted on such a service against your wish, you can contact us at hello@cheatcodemedia.net to request removal. We will not remove your personal information from the service unless you request it. We cannot guarantee that your information will be removed on request, however, if it cannot be removed we will always provide an explanation as to why it cannot be removed.

5. What choices do you have regarding the collection, use, adn distribution of your personal information?

You have choices over the Information provided by you and by other sources, and how CheatCode uses that Information. You can exercise your choices by updating your account preferences.

If you do not want to provide us with personal information, you can choose not to provide it. If you choose not to provide us with personal information, we may not be able to provide you the service you want.

You may control how third parties collect and use your information by opting our of collection directly with those third parties.

You can exercise choices over how we use your personal information at any time by updating your account settings. Please note that if you opt out of email communications, we may still contact you occasionally with important account updates.

6. Your California Privacy Rights

Without being discriminated against for exercising these rights, any user - including California Residents - can request that we disclose what personal information we collect from you, to delete that information, and to opt-out of the sale of your personal information (if we sell such information), subject to certain restrictions.

Should you submit such a request, we will verify your identity - in part by requesting certain information from you.

You also have the right to designate an agent to exercise these rights on your behalf.

Right to Know

If you are a California resident, you may submit, free of charge, but no more than twice in a 12-month period, a verifiable request for the following information:

  • The specific pieces of personal information we have about you;
  • The categories of personal information we collected, sold, or disclosed for a business purpose about you within the last 12 months;
  • The categories of sources from which the personal information was collected;
  • The purposes for which the information was collected or sold; and
  • The categories of third parties to whom the information was sold, disclosed for a business purpose, or otherwise stated.

If possible, we will provide this information in a easily digitally accessible format which allows transmission to another entity.

Right to Delete

You may submit a verifiable request for us to delete the personal information we have collected about you.

This is a permanent, irreversible action. All games, assets and history will be permanently deleted.

We main retain personal information necessary to:

  1. protect our business, systems, and users from fraudulent activity;
  2. address technical issues impairing existing functionality;
  3. enable us to exercise our free speech or other rights;
  4. comply with law enforcement requests pursuant to lawful process; and
  5. for our own internal purposes reasonbly related to your relationship with us

Right to Opt-Out

California residents may opt out of the sale of their personal information, as defined by the CCPA. This does not include when:

  1. you direct us to disclose your personal information or use us to interact with a third party and the third party does not sell the personal information;
  2. we share an identifier solely to alert a third party that you have opted out of the sale of your personal information;
  3. your personal information is transferred as an asset as part of a transaction, in which the third party assumes control of all or part of our business;
  4. we use or share your personal information under a written contract with a service provider necessary to perform a business purpose
    • In this case, the service provider is working on our behalf, and our written contract prohibits it from disclosing, keeping or using your personal information other than for the specific purpose intended in the contract.
    • As such, the disclosure of your personal information would not be considered a "sale" under CCPA.

CheatCode does not sell personal information to any vendor, has not in the last 12 months, and does not intend to do so in the future. Nonetheless, should you wish to opt out regardless, you may contact us in the same method as outlined in the Right to Know section.

Right to be Free from Discrimination

We may not, and will not discriminate against you because you have exercised your rights, including, for example:

  • denying you access to our services
  • charging you different rates or prices for the same services
    • in the event that the difference is reasonably related to the value provided by your data, we may charge a different rate

Privacy Rights for California Minors in the Digital World

California residents under the age of 18 have the right to view, correct and request the removal of content or information they have posted to message boards and forums.

This request can be made by contacting us via the method outlined in the Right to Know section. Please include [FAO Child Protection] in the email subject if writing us an email.

Please note that CheatCode strongly advises against posting personal or sensitive information online. For advise and support, young people can access ThinkUKnow and Childnet.

Residual copies of deleted data may remain on our backup servers. We may not remove anonymised content from our systems. We may retain your information to enforce our user agreements, comply with legal requirements or to resolve any disputes. In this event, your personal data will be marked to ensure it is not used for any other purpose.

Do Not Track

CheatCode are, for all products developed after December 31, 2021, making all reasonable efforts to enforce browser 'Do Not Track' settings. You can read more about Do Not Track at www.allaboutdnt.com. CheatCode cannot enforce Do Not Track requests with our third parties.

7. Nevada Residents

Under Nevada law, Nevada residents who have purchased goods and/or services from us may opt out of the "sale" of "covered information" for monetary consideration to a person for that person to license or sell such information to additional persons. "Covered information" includes first and last name, address, email address, and phone number, or an identifier that allows a specific person to be contacted either physically or online.

CheatCode does not sell personal information to any vendor, has not in the last 12 months, and does not intend to do so in the future. Nonetheless, should you wish to opt out regardless, you may contact us in the same method as outlined in the Right to Know section in (6).

8. Child Protection

CheatCode takes significant steps to ensure the welfare of young people using our services.

Children Under 13

Once a child states that their age is under 13, our system will prevent them from registering an account with us. We do not knowingly connect or store any personally identifiable information from children under 13. If parents or legal guardians believe we have unintentionally collected their child's personal information, they can contact us requesting its deletion in the same method as outlined in the Right to Know section in (6).

Data sharing of minors

We urge parents to instruct their children to never provide their real names, addresses, phone numbers or other personal information when online.

Teenagers under the age of 17 should encourage their parents to review this policy before using our services.

Child Protection Data Sharing

Should we believe there is a major concern for a child's safety or well-being, we may, without notice or consent share this information with the relevant law enforcement or child protection authority.

Law enforcement and child protection authorities can contact us at legal@cheatcodegames.net to make such a request for information. We are unable to disclose information without a warrant or sufficient evidence to warrant such a request, however.

9. What are tracking technologies

As is true with most websites, we automatically gather certain information and store it for logging purposes.

This information may contain information such as your Internet Protocol (IP) address, and non-personal information such as your browser type, operating system, referring/exit pages, operating system, clickstream data, timestamps and/or your Internet Service Provider. This is to improve services we offer you, marketing, analytics and functionality.

CheatCode and its partners (see footnote) may use tracking technologies such as cookies, beacons, tags and scripts. These technologies are used to analyse trends, administer our services, track user movements around our services, and to gather demographic information about our customers. We may receive reports based on the use of these technologies.

We use cookies for various purposes, including to remember settings and authentication. If you reject cookies, you may not be able to access certain features on our services.

We, and third parties whom we partner may provide features to display advertising based on your web browsing activity such as Local Storage in HTML5 and Cookies.

We partner with third parties to manage our advertising on other sites. Our ad partners may use tracking technologies to collect information about your activities on this and other websites to provide you targeted advertising based on your interests.

Some of these ad networks are members of the Networking Advertising Initiative, and/or the Digital Advertising Alliance - these organisations offer a single location to opt out of receiving tailored ads.

10. About Internet Protocol Addresses

An internet protocol ("IP") address is the unique number assigned to your server or Internet Service Provider ("ISP") - the company which provides you internet. We may track these IP addresses for system administration, site tracking, security purposes or to prevent abuse.

11. Information Security at CheatCode

We take an extensive range of security measures to protect your personal information, and keep it confidential (with the exception of non-confidential by nature data such as user-generated content, rankings, forum posts, public profile data etc). We also take steps to ensure personal information is protected from misuse and alteration.

We request our vendors to take appropriate information security measures when processing any CheatCode customer data.

While every attempt is made to protect and secure your data, the Internet cannot be considered secure and the nature and style of security risks and threats constantly changes and evolves - as are the industry standards and steps taken to secure systems. The complete security of any personal information collected or used by us or our vendors therefore cannot be guaranteed.

We encourage you to use a unique password which is changed regularly, and use two-factor authentication on your account.
